Terms of Use
Version 1.0 · Effective 5 September 2026
The short version
- These terms are for people using CareOp. Your employer has a separate agreement with us covering the service itself.
- Your account belongs to your employer. Use it for work, and don’t share it.
- CareOp is not an emergency service. If someone is in danger, call 000.
- Nothing here takes away rights you have under Australian Consumer Law.
1. Who these terms are for
These terms apply to you if you use the CareOp platform or the CareOp Worker mobile app: typically as a support worker, coordinator or administrator employed or engaged by a disability service provider that subscribes to CareOp.
CareOp is operated by Orion Technology Pty Ltd (ABN 51 701 742 690), of 4530 G/470 St Kilda Road, Melbourne VIC 3004. “We” and “us” in these terms mean that company.
Your provider has its own agreement with us covering fees, service levels and how data is handled. Where that agreement and these terms differ on something concerning the provider, that agreement wins. These terms cover your own use.
2. Your account
- Accounts are created by your provider. There is no public sign-up, and we cannot create or restore an account at your request, only your provider can.
- Your sign-in is personal. Do not share it, and do not let someone else record work under your name. The record of who provided a support is the point of the record.
- Tell your provider promptly if you think someone else has access to your account or device.
- Your provider can suspend or close your account at any time, including when you stop working for them.
3. Using it properly
You agree to:
- use CareOp only for your work with your provider;
- record information accurately and honestly, notes, times and incident reports are care and compliance records, and may be read by regulators, auditors or a court;
- respect the privacy of participants and colleagues, and access only records you need for your work;
- keep participant information confidential, including after you stop using CareOp. Do not copy, photograph or share it outside the platform except as your provider directs; and
- follow your provider’s own policies and the NDIS Code of Conduct.
You must not:
- attempt to access another provider’s data, or records you have no need to see;
- probe, scan or interfere with the platform’s security, or attempt to defeat its access controls;
- falsify a record, including a clock time or a location; or
- upload malicious code, or anything unlawful.
4. CareOp is not an emergency service
This is the most important clause on the page.
The “Check on me” safety timer and the duress alert notify people at your provider. They do not contact police, ambulance or fire, and they depend on your phone having signal, battery and a working data connection.
If you or anyone else is in immediate danger, call 000. Do not rely on this app to summon help. Nothing in it replaces your provider’s emergency procedures.
5. Not medical advice
CareOp records information and presents what a person has entered: care plans, medication schedules, observations. It does not diagnose, does not prescribe, and does not tell you what care to give. It is not a medical device. Clinical decisions remain with the appropriately qualified people at your provider.
6. Availability and offline use
The app is built to work without signal. You can clock on and write notes offline, and they sync when a connection returns, recorded at the time you acted rather than the time they synced. That is a genuine feature and not a guarantee: a device that is lost, wiped or reset before syncing loses whatever had not yet reached us.
We aim to keep the platform available at all times but do not promise uninterrupted service. We may need to suspend access for maintenance, and we may change or remove features.
7. Your information
How we handle personal and health information, including exactly when location is collected, is set out in our Privacy Policy, which forms part of these terms. If you want information deleted, see Delete your data.
8. Ownership
We own the CareOp platform, its software, design and branding. Using it gives you a personal, non-transferable right to use it for your work while your provider’s subscription lasts, and nothing more.
The records (notes, participant information, documents) belong to your provider, not to us. We hold them on their behalf, and we do not sell them or use them for advertising.
9. Liability, and what cannot be excluded
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Where a consumer guarantee applies and we fail to meet it, our liability is limited, to the extent the law allows, to resupplying the service or paying the cost of having it resupplied.
Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential loss, and we are not liable for loss caused by information a person entered incorrectly, by your provider’s own decisions or policies, or by a device, network or third-party service outside our control.
10. Changes
We may update these terms. The current version is always at this address with its effective date. Where a change materially affects you we will give notice in the app before it takes effect. Continuing to use CareOp after that means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria.
